Jeffrey
Segal, MD, JD Neurosurgeon/Founder/CEO
Medical Justice Services, Inc. Greensboro, NC
Jeffrey Segal, MD, JD
At any one moment, there are
over 50,000 open malpractice
lawsuits against healthcare
professionals. The majority of
these will result in no payment
to the patient, but this will be
cold comfort. A doctor in the
crosshairs of a lawsuit can
expect to spend an average of
five years defending his
reputation before resolution.
Those who win do not feel like
winners. They just lose less.
The presentation will focus on
how lawsuits evolve. What
motivates patients to sue? What
strategies can be implemented to
prevent escalation? This - and a
collection of other thorny
medico-legal issues – and
solutions – will be addressed.
Next, in 2011, challenges to
reputation involve more than an
assault in a courtroom. With the
Internet, if a patient is
unhappy he or she needs do
little more than access a
growing number of Internet
doctor rating sites. Today,
anyone with a mouse, a broadband
connection, and a grudge can
create permanent damage to a
doctor’s most precious asset –
his or her reputation. More than
60 sites allow such criticism to
be rendered anonymously. Those
with an axe to grind can pose as
patients, such as disgruntled
office staff, competitors, or
even ex-spouses. The posts are
disseminated worldwide, and once
posted, the criticism rarely
comes down. While transparency
is a laudable goal, such sites
generally lack any
accountability. The presentation
will also focus on strategies
for protecting one’s reputation
in cyberspace – monitoring what
is being said; promoting the
positive; and addressing the
negative.
It takes a lifetime to learn the
skills to practice medicine at
the highest level, establishing
an impeccable reputation. It
takes a day to destroy. With the
right tools, navigating
successfully through the
medico-legal world and
cyberspace can be done.
Objectives:
-
Understand how lawsuits
against doctors develop.
-
Understand how to prevent
escalation of conflict into
a lawsuit.
-
Understand the impact of
doctor rating sites on
reputation.
-
Understand what strategies
can be implemented to
prevent damage to reputation
by such sites
-
Understand what strategies
can be implemented to
promote positive reputation
in cyberspace
